REGULATIONS FOR THE SALE OF TICKETS AND ONLINE BOOKINGS

§ 1 General Provisions These regulations (hereinafter referred to as the "Regulations") define the rules for booking and selling admission tickets to the Flyport by Baltona educational and entertainment zone, located in the departure terminal of Warsaw-Radom Airport, at ul. Lubelska 158, 26-603 Radom (hereinafter referred to as "Flyport"). Ticket sales are conducted by Przedsiębiorstwo Handlu Zagranicznego “Baltona” S.A., headquartered in Warsaw (02-146), at ul. Komitetu Obrony Robotników 49, entered into the register of entrepreneurs kept by the District Court for the Capital City of Warsaw, XIV Economic Department of the National Court Register under KRS number: 51757, REGON number: 000144035, NIP number: 5860102292 (hereinafter referred to as "Baltona"). Ticket sales are carried out through the website available at www.biletyflyport.pl (hereinafter referred to as the "Website"). The purchase or reservation of tickets to Flyport via the Website is only possible after accepting the Regulations and the “Regulations of the Flyport by Baltona Educational and Entertainment Zone,” which are available on the website at www.flyport.pl. The current schedule of days and hours of entry to Flyport is provided on the website www.flyport.pl. Tickets can only be purchased individually via the Website, while reservations for organized groups can only be made. By purchasing a ticket through the Website, the buyer enters into a remote contract with Baltona for the purchase of the ticket. The buyer is not entitled to a ticket refund, and in the case of consumers, refunds are not possible due to the conclusion of a distance contract, in accordance with Article 38(1)(12) of the Consumer Rights Act of May 30, 2014 (Journal of Laws of 2023, item 2759), unless otherwise stated in these Regulations.

§ 2 Online Ticket Reservation for Groups (Group Tickets) An organized group is defined as a group of ten [10] or more people. For every ten [10] people in the group, one [1] free ticket is granted to the group leader. Each online group ticket reservation receives its own individual number and requires payment through a separate transaction. When reserving group tickets online, you must choose the day and time of the visit to Flyport, and then enter in the data form: the name and surname of the person making the reservation, phone number, email address, full name of the institution, the appropriate type and number of tickets from available price categories, and all necessary data for issuing the invoice. If the person making the reservation has selected the “VAT Invoice - Yes” option in the reservation system, the invoice will be ready for collection on-site along with the Flyport admission tickets. The invoice may be sent electronically only upon prior telephone or email request (rezerwacje@flyport.pl) from the visitor. After making a reservation as mentioned in paragraph 5 above, the person making the reservation will receive a confirmation of the reservation via email. Payment for the reservation must be made within ten [10] days from the moment of reservation to the bank account provided in the sent email. The date of successful payment is considered to be the date when the money is credited to Flyport’s account. For international transfers, a longer processing time must be considered. Until the payment is received in Flyport’s account, the reservation is temporary until the expiration of the deadline specified in this provision. If the payment is not made within the timeframe described in paragraph 6 above, the reservation will be canceled. After making the payment, and thus successfully paying for the reservation, a VAT invoice will be issued, and tickets will be printed, which must be collected at the Flyport ticket office no later than on the day of the visit and no later than 30 minutes before the start of the tour. The group reservation procedure can be started up to 180 days in advance and no later than five [5] days before the scheduled visit to Flyport.

§ 3 Online Ticket Purchase for Individuals When making a purchase, you must choose the day of the visit to Flyport, then enter in the data form: the name and surname of the person making the reservation, phone number, email address, and type and number of tickets. Tickets for individuals can be purchased up to 60 days in advance. A family ticket covers one [1] slot for a given date for up to two [2] adults, according to §4(1)(5) of the Regulations. Children under the age of three are entitled to free admission to Flyport. If the person making the reservation has selected the “VAT Invoice - Yes” option in the reservation system, the invoice will be sent electronically. Payment for the reservation must be made within one [1] hour from the moment of reservation (either directly from the Website or via the link provided in the email sent to the email address given during the purchase). Baltona allows payments using the Autopay payment system. Before making the payment, you should verify if the system supports the bank from which the payment will be made or use a payment card acceptable by the system. To make the payment, the buyer should follow the instructions displayed on the payment provider’s website, i.e., Autopay. Each online ticket purchase for individuals will receive its number. Each buyer will receive the tickets electronically. By selecting the appropriate option during the ticket purchase, it is possible to collect tickets at the Flyport ticket office based on the purchase number mentioned above. If payment is not made within the timeframe described in §6, the reservation will be canceled. The customer is responsible for the correct printing of tickets and for safeguarding the tickets in their email inbox. Re-sending the ticket is not possible.

§ 4 Types of Tickets

Tickets to Flyport are divided into the following categories:

  1. Standard Ticket – available to an adult, i.e., a person who is 18 years old or older.
  2. Discounted Ticket – available to: a) children and school-aged youth up to 18 years of age (students, upon presentation of a school ID); b) holders of the Polish Card (upon presentation of the Polish Card), under 18 years of age; c) individuals under 18 years old with disabilities (upon presentation of a disability certificate and an ID with a photo or disability ID; in the case of individuals with a significant degree of disability, purchasing a ticket entitles entry with a disability assistant, for whom a separate free ticket must be obtained);
  3. Discounted Adult Ticket – available to: a) school-aged youth between 18 and 19 years old (upon presentation of a school ID); b) students and doctoral candidates up to 26 years old (upon presentation of a student or doctoral ID); c) holders of the Polish Card (upon presentation of the Polish Card); d) retirees and pensioners (upon presentation of an ID with a photo, or if the ID does not have a photo – the ID and a personal identification document); e) seniors over 65 years old (upon presentation of an ID with a photo); f) individuals over 18 years old with a disability (upon presentation of a disability certificate and an ID with a photo or disability ID); in the case of individuals with a significant degree of disability, purchasing a ticket entitles entry with a disability assistant, for whom a separate free ticket must be obtained);
  4. Group Ticket – available to organized groups of at least 11 people, including one [1] supervisor.
  5. Family Ticket – available for two adult individuals, i.e., over 18 years old.

Entry to Flyport is free for children under 3 years of age, though a free ticket must be obtained for them at the Flyport ticket office. Obtaining a free ticket is possible when purchasing a ticket described in §4(1)(1), (3), or (5) of the Regulations (i.e., standard ticket, discounted adult ticket, or family ticket).

Each type of ticket specified in this §4 of the Regulations entitles the holder to entry to Flyport, according to the information provided on the ticket.

The ticket holder is responsible for properly storing and securing the ticket. In case of any discrepancies between the ticket and the order, this should be promptly reported to Baltona via email at: rezerwacje@flyport.pl.

§ 5 Contact

Contact using the forms provided in paragraph 1 above is available on the following days and times: Monday to Friday, from 8:00 AM to 4:00 PM.

§ 6 Complaints

Complaints related to ticket purchases via the Website can be submitted electronically by sending the complaint to: reklamacje@flyport.pl or in writing to: Przedsiębiorstwo Handlu Zagranicznego “Baltona” S.A., ul. Komitetu Obrony Robotników 49, 02-146 Warsaw.

Baltona will address the complaint promptly, but no later than 14 days from its receipt, in the form in which the complaint was submitted, unless the complaint indicates that a response is to be provided in another form.

Utilizing the complaint procedure is a form of amicable dispute resolution. Regardless of whether the complaint is deemed justified or not, the complainant has the right to pursue claims through the courts.

Consumers may also use alternative methods of complaint resolution and claims pursuit, particularly by seeking assistance from consumer organizations or municipal (district) consumer ombudsmen. Detailed information on the consumer's right to alternative dispute resolution and access to these procedures can be found on the Office of Competition and Consumer Protection website: www.uokik.gov.pl.

Consumers also have the option to use the EU online ODR platform, available at: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=PL

§ 7 Personal Data Protection

Your personal data will be processed in accordance with applicable law, specifically the Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L of May 4, 2016, No. 119/1) (hereinafter: GDPR).

The administrator of your personal data processed in connection with the online ticket purchase is: Przedsiębiorstwo Handlu Zagranicznego “Baltona” S.A., headquartered in Warsaw (02-146), at ul. Komitetu Obrony Robotników 49, entered into the register of entrepreneurs kept by the District Court for the Capital City of Warsaw, XIV Economic Department of the National Court Register under KRS number: 51757, REGON number: 000144035, NIP number: 5860102292 (hereinafter: Administrator).

For matters related to personal data protection, you may contact the Administrator or the designated Data Protection Officer, via traditional mail – by sending an inquiry to the Administrator's address indicated in paragraph 1 above, or via email – by sending an inquiry to: rodo@baltona.pl.

The Administrator will process your personal data (name, surname, email address, phone number, payment information, data necessary for issuing an invoice – for sole proprietors) for the following purposes and based on the following legal grounds: a. Taking actions necessary to conclude a contract for the purchase of a ticket via the Website – based on Article 6(1)(b) GDPR; b. Taking actions related to the handling of the transaction required for the ticket purchase – based on Article 6(1)(b) GDPR; c. Handling complaints, if submitted, which constitutes a legitimate interest of the Administrator – based on Article 6(1)(f) GDPR; d. Fulfillment of legal obligations: tax obligations, as well as anti-money laundering requirements – based on Article 6(1)(c) GDPR; e. Pursuing claims and defending against claims, which constitutes a legitimate interest of the Administrator – based on Article 6(1)(f) GDPR.

Your personal data may be shared with entities cooperating with the Administrator, if such sharing is necessary for the fulfillment of the ticket purchase – e.g., IT service providers, accounting, legal services, payment solution providers.

Your personal data will not be transferred to third countries or international organizations.

Your personal data will be retained for the period necessary to fulfill the contract and to comply with legal obligations incumbent on the Administrator (generally – 5 years). In the case of pursuing claims or defending against claims, the Administrator will retain your data until the right to pursue claims expires or until the legal proceedings are concluded.

You have the right to request from the Administrator access to your personal data, their rectification, deletion, restriction of processing, as well as the right to object – in cases specified by the GDPR.

If you believe that your personal data is being processed unlawfully, you have the right to lodge a complaint with the President of the Office for Personal Data Protection (address: ul. Stawki 2, 00-193 Warsaw; email address: kancelaria@uodo.gov.pl).

Providing personal data is voluntary but necessary for concluding the ticket purchase contract. Refusal to provide personal data will result in the inability to purchase a ticket via the Website.

Your personal data will not be subject to automated decisions or profiling.

§ 8 Final Provisions

Flyport reserves the right to change a reservation in justified cases. In such cases, individuals who made an earlier reservation are entitled to either change the date or receive a refund for the tickets.

An invoice for entry to Flyport will be issued within seven (7) days from the date of ticket purchase. The invoice is issued based on the receipt.

Flyport reserves the right to amend these Regulations. The amended regulations will be made publicly available on the website www.flyport.pl and at the Flyport ticket offices. In the case of changes to the Regulations, the amendments will come into effect 14 days after the new version of the Regulations is published. Changes to the Regulations do not affect tickets purchased before the change, meaning that tickets bought prior to the amendment will be governed by the Regulations in effect on the date of purchase.

For ticket reservations, the prices indicated in the current price list apply.

These Regulations do not affect the provisions of the “Regulations of the Educational and Entertainment Zone Flyport by Baltona,” available on the website www.flyport.pl and at the Flyport ticket offices.

In matters not regulated by these Regulations, the provisions of the “Regulations of the Educational and Entertainment Zone Flyport by Baltona” apply accordingly.

These Regulations are governed by the laws applicable in the Republic of Poland (Polish law).

These Regulations are effective as of September 5, 2024.
